Terms of Nailfolio
Terms for using Nailfolio: accounts, plans, payments and service conditions.
The Polish version of these Terms of Service is the legally binding version. Translations into other languages are for informational purposes only.
1. Definitions
Platform, the Nailfolio web application available at nailfolio.app and as a mobile app, enabling nail stylists to showcase their portfolio and clients to browse inspiration.
Service Provider, …, NIP: …, registered at: …, Poland.
Stylist, a user with a STYLIST account who builds a nail design gallery and manages relationships with clients.
Client, a user with a CLIENT account who browses stylist galleries, saves favorite designs, and uses the pairing feature.
Account, an individual user account on the Platform, created by registering via Google or email address (magic link). A single user may hold both a Stylist account and a Client account at the same time.
Gallery, a collection of nail design photos uploaded by a Stylist, tagged with colors, style traits, and nail length.
QR Connection, a mechanism for linking a Client account with a Stylist account: the Client scans the Stylist's permanent QR code and sends a connection request, which the Stylist accepts.
Session Share, a feature for a Client to share photos with a connected Stylist. The Client selects a Stylist with whom she is directly connected or whom she can access through an active salon, and sends selected photos from the galleries available to her. Sharing takes place remotely. Photos remain available in the Stylist's Session Clipboard for 14 days after sharing.
Staff Account, salon team membership available on Studio and Scale plans. The owner invites a person by email address. The invited person signs in normally and creates a Stylist account if she does not already have one. The invitation acceptance link does not sign her in. After acceptance, that person's name and photo appear in the team list. Membership gives access to the shared salon gallery, without access to other Stylists’ private clients, notes or conversations.
2. Registration and Accounts
Using the Platform requires being at least 16 years old. People under 16 may not register an account on the Platform on their own. By registering an account, the user confirms that they are at least 16 years old (Art. 8 GDPR).
Registration on the Platform is done with a Google account or an email address (magic link). No password is required.
During the first steps, the user chooses their role: Stylist or Client. The chosen account type is fixed and cannot be changed, but the user can activate the second account type in settings (the dual-account architecture described below).
A single user may hold both a Stylist account and a Client account at the same time (dual-account architecture). The second account type can be activated in account settings. Switching between roles is done with a toggle in the app menu.
During the first steps, the Stylist provides: a publicly visible display name, a city, and optionally a phone number. The Client goes through simplified first steps (a welcome and accepting the terms).
The user is required to provide truthful information. Accounts created for abuse, spam, or breaking the terms may be suspended or deleted.
Each user can log in from several devices at the same time (multi-session). The list of active sessions is available in account settings.
3. Gallery Usage Rules
The gallery is intended solely for displaying nail design photos. It is prohibited to upload photos containing: faces of people, identity documents, offensive or illegal content, or content unrelated to nail design.
The Stylist tags each photo with colors (1-3), style traits (at least 1), and nail length (short, medium, long, XL). Tags let clients filter the gallery.
Gallery photo limits depend on the pricing plan: Free Demo plan, up to 5 photos, Pro plan and higher, unlimited. Once the limit is reached, the Stylist cannot add new photos without deleting older ones or moving to a higher plan.
The Stylist may pin selected photos to the top of the gallery (pinned). The number of pinned photos depends on the plan: Free Demo plan up to 3, Pro plan up to 10, Pro Marka plan up to 15, Studio plan up to 30, Scale plan up to 50. Pinned photos are visible on the Stylist's public profile and appear first in the gallery.
Colors and style traits are defined globally by the Platform administrator, the Stylist cannot add her own tags.
4. QR Connection
A QR Connection gives a Client access to the Stylist’s full gallery and, in an active salon, to the galleries of all members contributing their work, with the ability to contact each of them. Every Stylist has a permanent QR code in the app that leads to her public profile. The code can be printed, shown on a phone screen or shared as a link.
The Client scans the code, signs in to her account and sends a connection request. The request alone does not give access to the full gallery. The Stylist can accept or decline the request, and the Client can cancel it until it has been decided. Once the request is accepted, a permanent connection is created between the Stylist and Client accounts, and the Client gains access to the full gallery, filters, and the ability to save favorite designs.
The limit of three connections applies only to the Client’s direct connections with Stylists; connections obtained through a salon do not count towards this limit. Once the limit is reached, the Client must end one of the connections to add a new one.
Connected Client limits for Stylists depend on the plan: Free Demo plan, up to 2 clients, Pro plan and above, unlimited.
The Stylist can end the connection with a Client at any time. In such case, the Client loses access to the full gallery, open inspiration sessions are closed, and her favorite designs from that gallery are deleted, except designs pinned on the Stylist's public profile.
6. Plans and Payments
Clients use the Platform free of charge. Pricing plans apply only to Stylist accounts.
Available plans: Free Demo (free, up to 5 photos, up to 2 paired clients), Pro (paid, unlimited photos and clients), Pro Marka (paid, expanded pinned photo and public profile limits, no staff accounts), Studio (paid, like Pro Marka plus the ability to invite members to a salon team), Scale (custom, for large salons).
Payments are handled by the external provider Stripe. The Platform does not store payment card data. Plan changes are available in the app. Subscription cancellation and access to invoices are handled through the Stripe customer portal.
A 30-day free trial is available for the Pro, Pro Marka, and Studio plans. Starting the trial requires entering a payment card in Stripe. When the trial ends, the subscription automatically moves to the chosen paid plan unless the user cancels during the trial period.
Moving to a higher plan takes effect immediately. Moving to a lower plan takes effect at the start of the next billing period. After a subscription is canceled, the account stays active until the end of the paid period.
7. Staff Accounts (Employee Accounts)
Salon teams are available on Studio and Scale. The owner may invite any person by email.
Invitations may be accepted from the email link or in the app. The link does not sign anyone in. The invited person signs in normally and creates a Stylist account if she does not already have one. An accepted member uses the salon owner’s active paid plan capabilities on her own account while both membership and that plan continue. Membership makes works available in the shared salon gallery with their author identified. Contribution is enabled by default; each member may turn it off. Each Stylist’s clients, notes and messages remain private. Leaving the team or ending the salon plan removes access through the salon; turning off contribution removes the member’s works from the salon gallery. The member’s own works and direct connections remain on her account. The owner may show the team on the salon public profile at /s/[slug], and each member may opt out of being listed.
The account owner bears full responsibility for actions performed by employees through Staff Accounts. The Service Provider is not responsible for disputes between the account owner and employees.
8. Intellectual Property Rights
Photos uploaded to the gallery remain the property of the Stylist who uploaded them. By uploading a photo, the Stylist grants the Service Provider a non-exclusive, royalty-free license to display the photo within the Platform (including the public profile, paired Clients' galleries, and the Session Clipboard).
The Stylist represents that they hold the rights to the uploaded photos and that the photos do not infringe third-party rights. The Service Provider is not liable for copyright infringements by users.
Clients may not download, copy, or distribute gallery photos without the Stylist's consent.
The name, logo, and interface of the Nailfolio Platform are the intellectual property of the Service Provider.
9. Liability and Limitations
The Platform is provided on an as-is basis. The Service Provider makes reasonable efforts to ensure continuous operation of the Platform but does not guarantee uninterrupted availability.
The Service Provider is not liable for: the quality of cosmetic services provided by Stylists, the content of photos uploaded by users, damages resulting from technical interruptions or outages, data loss resulting from force majeure.
The total liability of the Service Provider to any user is limited to the amount paid by the user for Platform services in the preceding 12 months, to the maximum extent permitted by mandatory law. This limitation does not exclude liability that cannot be limited toward consumers.
10. Termination and Account Closure
The user may close their account at any time in the app settings. After closure, the account stays restorable (recovery) for 90 days. After 90 days from closure, self-service restoration expires and the account is permanently closed. We retain data only to the extent required by legal obligations, in line with the Privacy Policy.
Within 90 days of closing the account, the user may restore it along with all data (photos, pairings, settings) by logging in again and confirming the restoration.
The user can obtain permanent erasure of their data at any time by submitting a data erasure request (Art. 17 GDPR) to …. We fulfill the request subject to legal obligations (for example the duty to keep billing data). Data retention rules are described in the Privacy Policy.
The Service Provider reserves the right to suspend or close a user's account in the event of terms violations, actions harmful to the Platform, or harm to other users.
11. Right of Withdrawal
Pursuant to Article 27 of the Polish Consumer Rights Act of 30 May 2014, consumers and sole traders (JDG) have the right to withdraw from a distance contract within 14 days without giving any reason.
The right of withdrawal does not apply to the supply of digital content not supplied on a tangible medium, for which the consumer is obliged to pay a price, where performance has begun with the consumer's express prior consent, the consumer has acknowledged that the right of withdrawal is thereby lost, and the trader has provided contract confirmation on a durable medium (Article 38(13) in conjunction with Article 21 of the Consumer Rights Act). For a digital service started before the end of the withdrawal period, the rules on payment for services performed up to withdrawal apply if the user expressly requested the start of performance before that period expired (Article 35 of the Consumer Rights Act).
For paid subscriptions (Pro, Pro Marka, Studio, Scale), the service commences upon subscription activation or activation of a trial requiring a payment card. By accepting these Terms and starting a paid subscription or such trial in Stripe, the user consents to the commencement of service before the expiry of the 14-day withdrawal period and acknowledges the consequences of such commencement. Transaction confirmation is delivered on a durable medium (payment confirmation email).
12. Complaints
Users have the right to file a complaint regarding the services provided. Complaints should be sent to: ….
A complaint should include: the email address associated with the account, a description of the issue, and the desired resolution.
The Service Provider will process the complaint within 14 days of receipt. A response will be sent to the email address from which the complaint was submitted.
If the complaint is not resolved to the user's satisfaction, the user may: refer the matter to mediation at the Provincial Trade Inspection, refer the matter to a common court, file a complaint with the President of UOKiK, or use another competent out-of-court consumer dispute resolution mechanism.
13. Final Provisions
These Terms are governed by Polish law. Any disputes arising from the use of the Platform shall be resolved by the court having jurisdiction over the Service Provider's registered office in Krakow. This clause does not limit the rights of consumers, or sole traders contracting directly in connection with their business where the contract is not professional in nature for them, under mandatory court jurisdiction rules.
The Service Provider reserves the right to amend these Terms. Users will be notified of material changes at least 14 days in advance via the Platform.
Matters not covered by these Terms shall be governed by applicable provisions of Polish law, including the Civil Code and the Act on Provision of Electronic Services.
The Polish version of these Terms is the legally binding version. Translations are for informational purposes only.
